• Absence Of Easement

    I am purchasing some land which currently has no access way. The plan is to create accessway over unregistered land. The seller has offered a Defective title and Absence of Easement Policy. the policy is subject to the land being used for 12 months without inference or objection etc however as there is currently no accessway over the unregistered land how can the policy be valid.

    The policy is valid but as the conditions of the policy are not met, the policy is ineffective and, therefore, worthless.
