• Split Freehold Titles

By Guest on 21st Jul 2016

The freeholder of my property lived downstairs and owned the freehold to both properties under two separate titles. The property has since been repossessed and only the freehold title to the downstairs property was transferred to the new owner and the original repossessed freeholder is still shown on my freehold title. This is now stopping me from selling my property as the freeholder of the downstairs property dosn't want my freehold title leaving the two properties with different freeholders. Is there anything I can do to rectify this situation?

I'm afraid all you can really do is attempt to trace the owner of your freehold and see if his is prepared to transfer it to you. You could then try and get the owner of the downstairs flat to join with you in merging the two freehold titles - it would be in both your interests. You could try a tracing agent to find your freeholder. Search "Tracing Agents UK" on Google

Thanks for your reply. The freeholder of my property is prepared to transfer for a premium the freehold to me. The problem I have is that the downstairs freeholder who believed he was the freeholder for both properties is now unwilling to help.
