• Which Standard Form Restriction To Use?

By Guest on 04th Nov 2019

My husband owns a house. Last year his ex was given 50% beneficial interest in the house in TOLATA proceedings. Previous t this I invested a large sum into the house to pay off mortgage arrears, home improvements, etc. I am now submitting RX1 and UN1, but am unsure which restriction to use on the RX1. Please help!

We advise you check the guidance at HM Land Registry here: https://www.gov.uk/government/publications/notices-restrictions-and-the-protection-of-third-party-interests-in-the-register/practice-guide-19-notices-restrictions-and-the-protection-of-third-party-interests-in-the-register

You should also check with the document/circumstances giving rise to the restriction to see which of these is most appropriate. The restriction you want depends on the outcome required as well - do you want to have to sign a certificate yourself, or can any conveyancer sign it? For example, Form N restrictions are quite common but may not be right for your particular circumstances. Your conveyancer will be best placed to advise you on this.
