• TR1 Legally Binding?

By Guest on 17th Sep 2019

My tr1 document advises that out ground rent is due to paid every 6 months however the estate management company are now demanding payment for the whole year in one payment. I have no arrears and have been paying six monthly for 6 years. Is the tr1 form legally binding or are they within their rights to change the payment schedule?

It depends on the exact wording but as the TR1 creates the obligation to pay it is ultimately the authoritative document unless there is provision elsewhere permitting the change in procedure.

See your Lease. It should state how and when rent is paid. Your Lease is your Contract with Your obligations and rights. The TR1 form was likely to have been mirroring your lease. Half annually payments of ground rent has been pretty much the standard.
