    It is not whether or not the title is absolute that matters it is how you hold property. If there is a restriction on the title saying that a disposition by a sole proprietor cannot be registered without an order of the court then you are tenants in common and ownership of the deceased's share passes according to his will or in the absence of a will, intestacy rules. If there is no such restriction then you are joint tenants and the deceased's share passes automatically to the survivor
