    If your mother lent 40000 to the new home owner and there is documentation to support this - then the money may well be owed to your late mother's estate however it will depend but upon the terms of the loan, it may not be possible to to demand the money immediately and sometimes the terms state that the mortgage/loan monies are to be written off in the event of the death of the lender, in which case the money would not be owed to the estate at all.)
