• Home Rights Notice

    I seperated from my husband last year. He owns the family home solely in his name. I have put a home rights notice in the propergy but do not want to receive any of the value of the home in the divorce which is currently ongoing. I am now trying to buy a property but have been told that I do not count as being a 1st time buyer because of the home rights notice. Is this correct?

    If the Home Rights Notice is a "major interest" in land then you would not be eligible. Give HMRC SDLT department a call and ask? Their number is 0300 200 3510
