• Covenant

    My late Fathers home is 5 months down the process of being sold and the solicitors handling the sale have just told me there is a covenant. It stipulates that it cant be sold to anyone under 60 years of age and our buyers are too young. I am perplexed it took so long for the solicitor to see this and want to know if it is legal to have such a covenant please.It was a council property and the people who live upstairs are council tenants who are under 30 years of age.

    Yes I'm afraid that whilst relatively uncommon these covenants are not unknown and are enforceable. Check with the landlord that it does wish to enforce it. If so then you will need to find another buyer.
