• Transfer Of Equity For Tenants In Common

    My Mother died recently. The probate process is complete. My Mother left her half of the house in trust to the executors while my Father is alive her half cannot be sold. Do we need a transfer of equity to show this change or can it remain as is until my Father dies?

    From the sounds of it only the equity has been left to the executors, so there is no change in the legal title to register. You may want to ask the Land Registry to note the death on the title though. As ever in these matters it is always best to seek the advice of a solicitor who specialises in the field. In this case, a wills and probate soecialist.
