• If A Piece Has Land Has A Caution On It

    If after completing and exchanging contracts it transpires that each sol was working off a different plan (surveyors plan that outlined the land to be sold in red)..... and having exchanged the seller won’t sign sign the new TP1 in order the transfer the land - and so a caution has to be put on the land - who owns that land ? The seller as he hasn’t given permission to transfer the deed - or the buyer because contracts have been exchanged and monies exchanged and kept ?

    The land is transferred on completion when you receive the signed TP1 so until then the land remains with the seller. The seller could be in breach of contract if they have exchange but not completed, but they still own the land.
